In this work, through the dogmatic method, limited to a brief analysis for publication reasons, we intend to identify the meeting points between economic and legal doctrine about the concepts of interest and capital. Then, we will show some of the problems presented by the distinction between compensatory and moratorium interest in the peruvian Civil Code. Finally, we will conclude that the money-rate of interest is the one that must be applied to the payment for the disposition of the money capital whose determination obeys the rules of the free market.Es precisamente la falta de consenso en la doctrina civilista, que mayoritariamente asimila a los intereses como ‘frutos civiles de capital’, lo que llamó nuestra atención hacia el estudio de los últimos aportes de la doctrina económica. En este trabajo, por medio del método dogmático, limitados a un breve análisis por razones de publicación, pretendemos identificar los puntos de encuentro entre la doctrina económica y jurídica acerca de los conceptos de interés y capital. Luego, mostraremos algunos de los problemas que presenta la distinción entre los intereses compensatorios y moratorios del Código Civil peruano.
