For this, the positions that consider that we would find ourselves in front of present goods are analyzed and the figure of the preventive annotation as a mechanism for future assets that have a pre-independence access to the registry.In this line, the advantages of the preindependence of apartments to be built and projected housing lots are studied, to preventively record the sale and mortgage in its case; and how this would constitute a form of guarantee for the buyers of these real estate units and the banks financing these acquisitions. Likewise, a study is made of the sale and purchase of future assets, of financing and guarantees in real estate projects; and how the figure of pre-independence could contribute to boost the real estate market. Finally, the conclusions and proposals of this work are expressed.El presente artículo trata sobre la inscripción en los registros públicos de los departamentos por construir y de los lotes de vivienda proyectados, a raíz de la prohibición del artículo 1106 de nuestro Código Civil de constituirse hipoteca sobre bienes futuros.Para ello, se analizan las posturas que consideran que nos encontraríamos frente a bienes presentes y la figura de la anotación preventiva como un mecanismo para que accedan al registro bienes futuros que cuenten con una preindependización.En esta línea, se estudian las ventajas de la preindependización de departamentos por construir y de lotes de vivienda proyectados, para anotar preventivamente la compraventa e hipoteca en su caso y cómo ello constituiría una forma de garantía para los compradores de estas unidades inmobiliarias y los bancos financiadores de estas adquisiciones.Asimismo, se hace un estudio de la compraventa e hipoteca de bienes futuros, de la financiación y garantías en los proyectos inmobiliarios y de cómo la figura de la preindependización podría contribuir para dinamizar el mercado inmobiliario.
