Thus, recognizing the importance of this legal regime to empower the role of the State in the environmental management of investment projects, as well as the prevention of socio-environmental conflicts, a review of the current institutional framework is carried out, specifically the changes and advances regarding the exercise of functions by Senace. In this line, the scope of an interpretative conflict related to the scope of non-significant environmental impacts on bodies of water is presented. Likewise, a critical view of the corrective environmental management instruments is presented. Finally, some ideas are presented regarding the procedure for updating environmental studies as a mechanism for the continuous improvement of environmental management instruments.El presente artículo plantea una mirada crítica sobre la aplicación del Sistema Nacional de Evaluación de Impacto Ambiental. Por lo que, partiendo de reconocer la importancia posee dicho régimen legal para empoderar rol del Estado en la gestión ambiental de proyectos de inversión, así como la prevención de conflictos socioambientales; se realiza una revisión del marco institucional actual, específicamente los cambios y avances en torno al ejercicio de funciones por parte del Senace. En esa línea, se exponen los alcances de un conflicto interpretativo relacionado con el alcance de los impactos ambientales no significativos en cuerpos de agua. Asimismo, se plantea una visión crítica respecto a los instrumentos de gestión ambiental correctivos.
