These phenomena, in many cases, call into question the role of constitutionalism as a guarantor of rights, especially when domestic policies promote initiatives that weaken the fundamental principles upon which constitutional orders are built.In this context, Dr. Luigi Ferrajoli offers a reflection based on his extensive academic and professional experience. Throughout the interview, he analyzes the relationship between the international political situation and the development of constitutionalism, emphasizing the need to strengthen mechanisms that ensure the effective protection of individuals. He also elaborates on his proposal for a ‘Constitution of the Earth’ as a normative framework aimed at guaranteeing universal rights that transcend state borders. Finally, it expresses concern about the growing prioritization of economic efficiency at the expense of social rights, highlighting the importance of subjecting the power of economic agents to clear legal limits.En los últimos años, el Derecho Constitucional se ha enfrentado a una serie de desafíos derivados tanto del avance de las nuevas tecnologías como del impacto del cambio climático, así como de las transformaciones en las políticas migratorias y económicas de los Estados. Estos fenómenos, en muchos casos, ponen en cuestión el rol del constitucionalismo como garante de derechos, especialmente cuando, desde la propia política interna, se impulsan iniciativas que debilitan los principios fundamentales sobre los que se edifican los ordenamientos constitucionales.En este contexto, el Dr. Luigi Ferrajoli ofrece una reflexión sustentada en su amplia trayectoria académica y profesional. A lo largo de la entrevista, analiza la relación entre la coyuntura política internacional y el desarrollo del constitucionalismo, subrayando la necesidad de fortalecer mecanismos que aseguren la protección efectiva de las personas. Asimismo, profundiza en su propuesta de una ‘Constitución de la Tierra’ como marco normativo orientado a garantizar derechos universales por encima de las fronteras estatales.
