For this reason, it is essential that laws protect competition, since their purpose is to promote general welfare through a fairer market, preventing, for example, companies with greater market power from using it abusively or prohibiting agreements that restrict, distort or limit competition between companies. In this context, this paper examines the interaction between the prohibition of abuse of dominant position and the prohibition of anticompetitive vertical agreements, as regulated by Legislative Decree 701.Un mercado competitivo es una herramienta que permite distribuir los recursos entre los consumidores con el fin de satisfacer las necesidades de aquellos. Por su parte, la competencia entre las empresas desempeña un papel crucial en este proceso porque, a través de ella, se busca maximizar el bienestar de los consumidores. Por esta razón es fundamental que las leyes protejan la competencia, ya que su propósito es fomentar el bienestar general a través de un mercado más justo; evitando, por ejemplo, que las empresas con mayor poder en el mercado lo empleen de manera abusiva o prohibiendo aquellos acuerdos que restrinjan, falseen o limiten la competencia entre las empresas.
