It is recognized that general principles, divided into different levels, are conceived as the backbone of the rules, while labor principles, such as the protective principle, the most favorable rule and the most beneficial condition, are designed to mitigate the inequality inherent in the labor relationship between employer and employee. In addition, it is emphasized that labor principles acquire great prevalence in cases of normative conflict within this area, prioritizing the protection of workers' rights, even in the face of hierarchically superior provisions. The author also emphasizes that the principles are not only interpretative tools, but dynamic reflections of values and social consensus, such as labor stability, which has evolved to become consolidated as a constitutional right in Peru. This approach highlights the living and adaptable nature of the law in the face of social transformations.El texto examina la relación entre los principios generales del derecho y los principios particulares del derecho laboral, destacando su rol como fundamentos del ordenamiento jurídico. Se reconoce que los principios generales, divididos en distintos niveles, se conciben como vertebradores de las normas, mientras que los principios laborales, como el principio protector, de la norma más favorable y de la condición más beneficiosa, están diseñados para mitigar la desigualdad inherente en la relación laboral entre empleador y trabajador. Además, se subraya que los principios laborales adquieren gran prevalencia en casos de conflicto normativo dentro de este ámbito, priorizando la protección de los derechos de los trabajadores, incluso frente a disposiciones jerárquicamente superiores. El autor también destaca que los principios no solo son herramientas interpretativas, sino reflejos dinámicos de los valores y consensos sociales, como la estabilidad laboral, que ha ido evolucionando hasta consolidarse como un derecho de rango constitucional en el Perú.
