An emblematic achievement of these is the subjectivization of nature, i.e., its recognition as a subject with rights, and that is reflected for the first time at the planetary level in the Ecuadorian Constitution enacted in 2008; in the Bolivian laws of 2010 and 2012; with nuances in the Colombian Constitution of 1991, and in the so-called Peruvian Ecological Constitution of 1993. The analytical framework alludes to the philosophical-ontological understanding of nature from a systemic perspective, and an empirical study of four sentences related to the realization of the rights of nature and dictated by the high courts of Ecuador, Colombia, Bolivia and Peru, indistinctly, is developed. A relevant objective is to note that without constitutional jurisprudence that protects the realization of the rights of nature, the subjectivation of such rights runs the risk of remaining an ideological-political utopia. The research strategy is based on the application of the so-called multiple case study method.El presente artículo acota un enfoque contextual de la crisis ambiental denominada «crisis de nuestro tiempo», y pone en evidencia que, frente a la recomposición hegemónica neoliberal, se fortalecen perspectivas ambientalistas y socioecológicas en clave posantropocéntrica. Un logro emblemático de estas constituye la subjetivación de la naturaleza, es decir: su reconocimiento como sujeto con derechos, y que consta por primera vez a nivel planetario en la Constitución ecuatoriana promulgada en el año 2008; en las leyes bolivianas de 2010 y 2012; con matices en la Constitución colombiana de 1991, y en la denominada Constitución ecológica peruana de 1993. El marco analítico alude la comprensión filosófico-ontológica de la naturaleza desde una perspectiva sistémica, y se desarrolla un estudio empírico de cuatro sentencias relacionadas con la concreción de los derechos de la naturaleza y dictadas por las altas cortes de Ecuador, Colombia, Bolivia y Perú, indistintamente. Un objetivo relevante es connotar que sin jurisprudencia constitucional que tutele la concreción de los derechos de la naturaleza, su subjetivación corre el riesgo de quedar como una utopía ideológico-política.
