However, there is a conflict between the general prohibition of the use of force and the new doctrine when the latter is applied without UN Security Council authorisation. This article analyses the scope and pertinence of the Responsibility to Protect, concluding that it must be understood within the frame of the UN Charter and the general prohibition of the use of force. The strengthening of both the Security Council and the relevant international regimes seems to be the best way to deal with such crises, where as according to current international public law a new exception to the general prohibition—such as the Responsibility to Protect—does not seem to be either a proper or a lawful option.Frente a las graves crisis humanitarias y a las masivas violaciones a los derechos humanos de las últimas tres décadas, la responsabilidad de proteger ha sido presentada como una nueva doctrina —una versión menos agresiva de la intervención humanitaria— que permitiría a la comunidad internacional enfrentar dichas situaciones. Sin embargo, existe un conflicto entre la prohibición general del uso de la fuerza y la aplicación de la nueva doctrina cuando no haya una autorización del Consejo de Seguridad de la ONU. En este trabajo se analiza el alcance y pertinencia de la responsabilidad de proteger, desde la perspectiva del derecho internacional público, y se concluye que debe ser tratada dentro del marco de la Carta de la ONU y de la prohibición general del uso de la fuerza.
