The study seeks to determine whether consent given by a person under the influence of alcohol may still be regarded as free, informed, and voluntary in the context of sexual relations, even when the alcohol consumption itself was voluntary. Furthermore, based on the premise that consent is a gradable concept, the article identifies three categories of cases that reflect varying degrees of impairment of consent in such contexts. Finally, the article argues that individuals engaging in sexual relations with a person under the influence of alcohol must pay attention to certain indicators that may reveal whether that person’s decision-making capacity is impaired to a degree that invalidates consent, thereby creating a potential risk of criminal liability for sexual assault.El presente artículo aborda una problemática relativamente reciente: la afectación del consentimiento en el delito de agresión sexual en contextos de consumo de alcohol. En particular, se analizan aquellos supuestos en los que la víctima, tras haber ingerido bebidas alcohólicas de manera voluntaria, ve comprometida su capacidad para consentir libremente un acto sexual. El estudio tiene como objetivo determinar si el consentimiento otorgado por una persona bajo los efectos del alcohol —aun cuando el consumo haya sido voluntario— puede considerarse libre, consciente y voluntario en el ámbito de las relaciones sexuales. Asimismo, partiendo de la premisa de que el consentimiento constituye una categoría graduable, se identifican tres tipologías de casos que reflejan distintos niveles de afectación de la capacidad de consentimiento en este contexto.
