The public policy recommendations for guaranteeing rights and preventing the loss of parental care of minor children of persons deprived of liberty

The objective of this article is to provide recommendations for public policies that guarantee the conditions for effective access to justice, support and protection from the State to prevent and avoid that minor children lose parental care while their parents are serving a custodial liberty measure. The article addresses four points regarding the care of prisoners: a) the enhancement of the legal and jurisprudential framework on the guarantee of rights of persons deprived of liberty in relation to their minor sons and daughters; b) guidelines for the formulation, harmonization and implementation of national public policies around the guarantee of rights of the population in a situation of high vulnerability in prison contexts, through national and territorial development plans, focused on strengthening plans, programs, projects and strategies of comprehensive protection for the families of the prison population; c) the coverage of the National Protection System for minor children of persons deprived of liberty, through actions that prevent the loss of parental care, including the Administrative Measure for the Restoration of Rights, during periods of imprisonment of parents; and d) the need to strengthen the modalities of care for minor children of persons deprived of liberty, both in prisons and outside them, from the State’s offer.
