Thanks to the formula of shared custody, which we analyze in this paper, the children can have a greater enjoyment of the presence and care of both parents, who have the best conditions to define the most appropriate custody regime for their children according to their particular circumstances. The exercise of shared custody by separated parents is more effective if they have reached an agreement. The judge are going to ratify or not the agreement established by the parents as he considers or not suitable for the welfare of the child or adolescent. The custody must be ruled by the greatest benefit of children and not by a sense of justice or equity towards the parents.Dos de los conflictos familiares que más afectan a los hijos son la violencia familiar y la separación de los padres (sean casados o no); en estos casos, surge la necesidad de decidir cuál de ellos ejercerá la custodia de los hijos menores de edad o si recaerá en ambos. Gracias a la fórmula de la custodia compartida, la cual analizamos en este trabajo, los hijos pueden tener un mayor disfrute de la presencia y los cuidados de ambos padres, quienes poseen las mejores condiciones para definir el régimen de custodia más apropiado para sus hijos, de acuerdo con sus circunstancias particulares. El ejercicio de la custodia compartida a cargo de los padres separados es más eficaz si han llegado a un acuerdo.
