Nevertheless, we cannot conceive these principles from a positivist perspective; we must study them keeping in mind the existing concepts of justice, conceived from a certain ideology, belief, custom, etc. Based on them, understand the values that incarnate and nourish the ordering, as well as the ordering itself.La herencia del positivismo se ve plasmada en la relevancia que tiene para él, los principios de legalidad y de seguridad jurídica; que si fuesen tomados desde la perspectiva positivista, no podría hablarse de derecho, en tanto que la labor del juez se limitaría a la aplicación objetiva de la ley.
