Nowadays victimizations against the LGTBIQ+ community in Europe and more specifically in Spain have increased their numbers worryingly. Public Authorities play a key role in the prevention and struggling areas. In the same sense, they should guarantee this vulnerable group to be able to exercise their right of access to justice without barriers. Nevertheless, the statistics point out an important dark figure, being the distrust in criminal control institutions the main reason for the LGTBIQ+ community not reporting the facts related to their orientation, and/or sexualgender identity. This paper aims to offer a general overview of this issue in Spain and a review of the main public politics and some examples of good practices in the third sector entities that protect the right of access to justice for this community, strengthening and reforming institutions so they become friendly, confident, and safe places. |

Los poderes públicos juegan un papel fundamental no solo en la prevención y persecución de estos hechos delictivos, sino que además deben garantizar que este colectivo especialmente vulnerable pueda ejercitar su derecho de acceso a la justicia de forma plena y sin barreras de ningún tipo. Sin embargo, las estadísticas apuntan a una importante cifra negra, siendo la desconfianza en las instituciones del sistema de control penal el principal motivo que estas personas aducen para no denunciar hechos victimizantes relacionados precisamente con su orientación y/o identidad sexogenérica. Este trabajo se propone ofrecer una visión general de esta problemática en España y se hace una revisión de las principales políticas estatales y algunas buenas prácticas acometidas por entidades del tercer sector para garantizar el derecho de acceso a la justicia de este colectivo, reforzando y reformando las instituciones para que constituyan entornos seguros y confiables. Atualmente, o número de vitimizações LGTBIQ+ na Europa e mais concretamente em Espanha tem aumentado de forma preocupante. As autoridades públicas desempenham um papel fundamental não só na prevenção e repressão destes actos criminosos, mas também devem garantir que este grupo particularmente vulnerável possa exercer o seu direito de acesso à justiça de forma plena e sem barreiras de qualquer tipo. No entanto, as estatísticas apontam para uma significativa subnotificação, sendo a desconfiança nas instituições do sistema de justiça penal a principal razão apontada por estas pessoas para não denunciarem actos vitimizadores relacionados precisamente com a sua orientação sexual e/ou identidade de género.
