Due to restricted liability, its application was restricted to certain crimes, despite this, the restriction has been declared unconstitutional through diffuse constitutional control. It will be analyzed if the prohibition of suspension of the execution of the sentence in the crime 122­B can be inapplicable in attention to the similar situation of the age group that represents the restricted responsibility.El presente artículo tiene como finalidad analizar la implicancia de la responsabilidad restringida –grupo etario– frente a la prohibición de la suspensión de la ejecución de la pena en el delito 122­B sancionado con penas cortas, donde ambas instituciones jurídicas comparten una cuasi situación legal. Por la responsabilidad restringida se limitó su aplicación a ciertos delitos, pese a ello, la restricción ha sido declarada inconstitucional mediante el control constitucional difuso. Se analizará si la prohibición de suspensión de la ejecución de la pena en el delito 122­B puede ser inaplicable en atención a la símil situación del grupo etario que representa la responsabilidad restringida. O objetivo deste artigo é analisar a implicação da responsabilidade restrita –faixa etária– diante da proibição da suspensão da execução da pena no crime 122­B punido com penas curtas, onde ambas as instituições jurídicas compartilham uma quase situação jurídica. Devido à responsabilidade restrita, sua aplicação ficou restrita a determinados crimes; apesar disso, a restrição foi declarada inconstitucional por meio de controle constitucional difuso. Será analisado se a proibição de suspensão da execução da pena no crime 122­B pode ser inaplicável em resposta à situação semelhante da faixa etária que representa responsabilidade restrita.
