If it has been legally chosen to give the Judge the power to dispose the action of proof ex officio, the exercise of this power is guaranteed by the Constitution itself.Este artículo analiza un aspecto fundamental de la democracia constitucional: la jurisdicción, la cual le exige al juez conocer la ley y los hechos; ello implica establecer la verdad en correspondencia con la realidad, ya que sin ella no puede haber una decisión justa; por este motivo, en un Estado democrático constitucional, el juez debe procurar conocer la realidad de los hechos, pues el objeto esencial de todo proceso es la búsqueda de la verdad.
