Hence, facing the possibility of the breach of a duty or obligation imposed or assumed by the debtor, the guarantee constitutes the hope that such an obligation will be met and that the creditor’s loan will be satisfied. In this regard, the personal and real guarantees acknowledged by our civil and commercial laws are analyzed.El presente trabajo dirige su atención a las garantías en las relaciones jurídicas patrimoniales, es decir, en las relaciones jurídicas obligatorias o creditorias, en las que se identifica a dos partes o sujetos. De un lado, al sujeto activo, a quien se denomina acreedor o titular de un derecho de crédito; y, por el otro, al sujeto pasivo, denominado deudor u obligado frente al primero; por lo que ante la posibilidad de incumplimiento del deber u obligación impuesta o asumida por el sujeto pasivo —deudor—, la garantía constituye la esperanza de que tal obligación se cumpla y el acreedor vea satisfecho su crédito.
