Accordingly, it is important to analyze theoretical positions, such as the rights-based one, that help us to understand not only how to materialize the progress made in terms of protection of fundamental rights, but also to reflect on and criticize the activity of the legal system in its entirety, since it has a notoriously power undermining role. Thus, we will be able to account, with this epistemic starting point, how the very modification of the different normative statements, as well as the decision-making function of the judge, is conditioned thanks to the substantive contents of the constitutional rules.Los vestigios teóricos de las posturas paleo-positivistas han tenido como consecuencia directa una vehemente exaltación de la positivización de cualquier tipo de contenidos que se arguyan como derechos fundamentales, alegando con ello una adecuada regulación constitucional que, a la postre, sirve como discurso justificativo de la dominación estatal. Frente a esto, es importante analizar posturas teóricas como la garantista, que nos ayuden a comprender no solo cómo materializar los avances conseguidos en materia de protección a derechos fundamentales, sino también a reflexionar y criticar la actividad del sistema jurídico íntegramente, toda vez que su función ha sido notoriamente deslegitimadora del poder.
