For its development, the national and international doctrine, laws and case law are analyzed with the aim of proposing a legislative reform to guarantee the integral protection of the human rights of the mentally ill.El presente trabajo de investigación estudia el problema de la aplicación judicial de la medida de seguridad de internamiento para la persona en situación de inimputabilidad, debido a que en el ordenamiento jurídico penal persiste el modelo rehabilitador frente al modelo social dispuesto en la Convención sobre los Derechos de las Personas con Discapacidad.
