description The objective of the research is to demonstrate that, in Peru, the lack of recognition of gender identity in the National Identity Document (DNI) of transsexual women generates abuse and discrimination, in addition to violating their right to health and safety job. The present investigation addresses the problem that the Peruvian State refuses to recognize transsexual women regarding their gender identity. The normative and theoretical basis that supports the mistreatment and discrimination of transsexual women will be developed, as well as the analysis of the lack of health and work. The methodology applied in this research was based on the analysis of legal and jurisprudential documents, both national and international. The result of this research is to identify if there are problems regarding the right to health and work that affect transsexual women. The conclusion is that, in our Peruvian society, there is a heteronormative ideology that leads to rejection and limits the enrichment of our legal system, compared to other countries. It is recommended to implement procedures in the legal and administrative area of the Peruvian State, corresponding to processing, with greater speed and efficiency, the request for gender change in the DNI.

La presente investigación aborda el problema de que el Estado peruano se niegue a reconocer a la mujer transexual respecto a la identidad de su género. Se desarrollará la base normativa y teórica en que se sustenta el maltrato y discriminación de la mujer transexual, así como el análisis de la falta de salud y trabajo. La metodología aplicada en esta investigación se fundó en el análisis de documentos legales y jurisprudenciales, tanto nacionales como internacionales. El objetivo de la presente investigación es identificar si existen problemas referentes al derecho a la salud y al trabajo que afecten a las mujeres transexuales. La conclusión es que, en nuestra sociedad peruana, existe una ideología heteronormativa que conlleva al rechazo y limita el enriquecimiento de nuestro ordenamiento jurídico, en comparación con otros países. Se recomienda implementar procedimientos en el área legal y administrativa del Estado peruano, correspondientes a tramitar, con mayor celeridad y eficiencia, la solicitud del cambio de género en el DNI.O objetivo da pesquisa é demonstrar que, no Peru, a falta de reconhecimento da identidade de gênero no Documento Nacional de Identidade (DNI) das mulheres transexuais gera abusos e discriminação, além de violar o seu direito à saúde e à segurança no trabalho. A presente investigação aborda o problema da recusa do Estado peruano em reconhecer as mulheres transexuais quanto à sua identidade de gênero. Serão desenvolvidas as bases normativas e teóricas que sustentam os maus tratos e a discriminação das mulheres transexuais, bem como a análise da falta de saúde e de trabalho. A metodologia aplicada nesta pesquisa baseou-se na análise de documentos legais e jurisprudenciais, nacionais e internacionais. O resultado desta pesquisa é identificar se existem problemas quanto ao direito à saúde e ao trabalho que afetam as mulheres transexuais. A conclusão é que, em nossa sociedade peruana, existe uma ideologia heteronormativa que leva à rejeição e limita o enriquecimento do nosso sistema jurídico, em comparação com outros países.
