To this end, the dogmatic method will be used to analyze the concept of appeal, its purpose, its requirements, and the nature and significance of the grievance. Additionally, the exegetical method will be employed to engage with the various contradictory case laws regarding the requirement of the grievance. Finally, through the comparative method, the Colombian experience on the matter will be explored.El propósito de esta investigación es analizar críticamente la postura adoptada por el Pleno Jurisdiccional Nacional Constitucional y Procesal Constitucional de 2023 en virtud de la cual se sugiere a los jueces resolver las apelaciones, aunque la parte procesal haya obviado exponer los agravios. Para tal efecto, se utilizará el método dogmático, que permitirá analizar el concepto de apelación, su finalidad, sus presupuestos y la naturaleza e importancia del agravio. Además, se empleará el método exegético, pues se dialogará con diversas jurisprudencias contradictorias sobre la exigibilidad del agravio; y, por último, a través del método comparado, se explorará la experiencia colombiana sobre la materia.O propósito desta pesquisa é analisar criticamente a postura adotada pelo Plenário Jurisdicional Nacional Constitucional e Processual Constitucional de 2023, pela qual se sugere aos juízes resolver as apelações, mesmo que a parte processual tenha deixado de expor os agravos. Para tal efeito, será utilizado o método dogmático, que permitirá analisar o conceito de apelação, sua finalidade, seus pressupostos e a natureza e importância do agravo.
