description The criminal process is built upon the Constitution. Its legal regulation is not independent but arises inevitably from the fundamental norm of the State. It is precisely within this instrument that the general framework of principles is established, from which the specific rules governing the criminal process in a nation are derived. This theoretical core is referred to in Hispanic-American doctrine as the Procedural Criminal Program of the Constitution, and in Portuguese doctrine as the Procedural Criminal Constitution. It emerged in the 1980s, coinciding with the paradigm shift brought by the Spanish Constitution of 1978, and was later debated in Peru with the 1993 Constitution. In this context, it is logical that there are no research studies aimed at analyzing the historical procedural criminal program in national constitutions. Thus, this manuscript seeks to explore part of the procedural criminal program that developed during the 19th century in Peru, with a particular focus on the institution of trial by jury, a topic rarely addressed by national doctrine due to its ineffective implementation during that period. This text does not aim to provide an exhaustive analysis but rather an introduction to the concepts of the procedural criminal program of the Constitution and trial by jury, intended to promote their investigation and historical analysis.

La regulación legal que se le otorga no es independiente, sino que surge indefectible- mente de la norma capital del Estado. Es precisamente en este instrumento que se recoge el marco de principios generales que es a partir del que se sancionan las reglas específicas que rigen al proceso penal en una nación. A esta médula teórica se le denomina en la doctrina hispanoamericana Programa procesal penal de la Constitución, y en la portuguesa Constitución procesal penal. Nace en la década de los ochenta, con el cambio de paradigma de la Constitución española de 1978. Es, posteriormente, sometida a debate en el Perú con la Constitución de 1993. En tal sentido, es lógico que no existan trabajos de investigación dirigidos a analizar el programa procesal penal histórico en las constituciones nacionales. Así, con este manuscrito se pretende conocer parte del programa procesal penal que se gestó durante el siglo XIX en el Perú, y se hará un especial énfasis en la institución del juicio por jurados, escasa- mente abordado por la doctrina nacional por su ineficaz planteamiento durante tal época. No pretende este texto formular un análisis exhaustivo, sino una aproximación a los conceptos de programa procesal penal de la Constitución y al juicio por jurados, que permita difundir su investigación y su análisis histórico.O processo penal é baseado na Constituição. A regulamentação legal concedida não é independente, mas decorre infalivelmente da norma de capital do estado. É precisamente nesse instrumento que a estrutura de princípios gerais é estabelecida, a partir da qual as regras específicas que regem o processo penal em uma nação são sancionadas. Esse núcleo teórico é chamado de Programa processual penal da Constituição na doutrina latino-americana e, na doutrina portuguesa, de Constituição processual penal. Ele nasceu na década de 1980, com a mudança de paradigma da Constituição espanhola de 1978. Posteriormente, ela foi debatida no Peru com a Constituição de 1993. Nesse sentido, é lógico que não há nenhum trabalho de pesquisa destinado a analisar o programa processual penal histórico nas constituições nacionais. O objetivo deste manuscrito é fornecer uma visão de parte do programa processual penal desenvolvido durante o século XIX no Peru, com ênfase especial na instituição do julgamento por jurados, que quase não foi abordada pela doutrina nacional devido à sua abordagem ineficaz durante esse período.
