description In this article, we explore how a group of judges describe their experiences with the lack of knowledge displayed by lawyers who litigate before their courts. Through narrative interviews with five judges from the module of the National Specialized Justice System for the Protection and Punishment of Violence against Women and Members of the Family Group (SNEJ), we find that litigators are portrayed as professionals who do not do their homework, fail to prepare, lack even the minimum knowledge required before entering a hearing, and normalize their own ignorance. In response to these situations, judges present themselves as figures of authority who seek to preserve the integrity of hearings by giving lawyers a few minutes to read the case file, guiding them so they can fulfill their role, reprimanding or firmly exhorting them, or even urging defendants to change lawyers, among other measures. By contrast, judges do not impose fines or formal sanctions, rarely invoke ineffective assistance of counsel, and do not report cases to bar associations. On several occasions, judges express doubts about the role they should play when confronted with litigators’ lack of knowledge. At the same time, for most judges, ignorance is problematic but does not properly constitute an ethical issue, since it does not involve an intention to deceive or cause harm, nor does it rise to problems such as corruption. In many cases, there does not appear to be a clear conception of what constitutes a violation of professional ethics in litigation.

A través de entrevistas narrativas a cinco personas juezas de un módulo del Sistema Nacional Especializado de Justicia para la Protección y Sanción de la Violencia contra las Mujeres e Integrantes del Grupo Familiar (SNEJ), hallamos que se describe a los abogados y las abogadas como profesionales que no hacen su tarea, que no se preparan, que no conocen lo mínimo necesario antes de entrar a una audiencia, y que normalizan su propio desconocimiento. Frente a estos escenarios, los jueces y las juezas se presentan como figuras de autoridad que buscan preservar las audiencias, dan unos minutos a los abogados y las abogadas para que lean el expediente, los orientan a fin de que puedan cumplir su rol, les llaman la atención o los exhortan con firmeza, y apelan a que los acusados y las acusadas cambien de patrocinio, entre otras medidas. En contraposición, las personas juezas no ponen multas o amonestaciones, no suelen utilizar la figura de la defensa ineficaz ni comunican los casos a los colegios de abogados. En diversas ocasiones, los jueces y las juezas se presentan con dudas acerca del rol que deben jugar ante el desconocimiento de la abogacía. A su vez, para la mayoría del grupo estudiado el desconocimiento es problemático, pero no constituye propiamente un problema de carácter ético, ya que no estamos ante una intención de engañar o dañar, ni ante un problema como la corrupción. En diversos casos, no parece existir una concepción clara sobre qué es una infracción a la ética profesional en el litigio.Neste artigo, exploramos a forma como um grupo de juízes apresenta suas vivências diante do desconhecimento de advogados e advogadas que atuam em seus juízos. Por meio de entrevistas narrativas com cinco juízes do módulo do Sistema Nacional Especializado de Justiça para a Proteção e a Sanção da Violência contra as Mulheres e Integrantes do Grupo Familiar (SNEJ), constatamos que os(as) litigantes são apresentados(as) como profissionais que não fazem sua tarefa, não se preparam, não dominam sequer o conhecimento mínimo necessário antes de ingressar em uma audiência e normalizam o próprio desconhecimento. Diante desses cenários, os(as) juízes(as) se apresentam como figuras de autoridade que buscam preservar as audiências, concedendo alguns minutos aos advogados e às advogadas para a leitura dos autos, orientando-os(as) para que possam cumprir seu papel, chamando-lhes a atenção ou exortando-os(as) com firmeza, bem como sugerindo, em alguns casos, que os acusados mudem de advogado, entre outras medidas. Em contrapartida, não aplicam multas ou advertências formais, raramente utilizam a figura da defesa ineficaz e não comunicam os casos às ordens ou conselhos profissionais. Em diversas ocasiões, os(as) juízes(as) expressam dúvidas acerca do papel que devem desempenhar diante do desconhecimento dos(as) litigantes. Ao mesmo tempo, para a maioria dos(as) juízes(as), o desconhecimento é problemático, mas não constitui propriamente um problema de natureza ética, uma vez que não envolve intenção de enganar ou causar dano, nem se equipara a questões como a corrupção.
