However, the applicability of this Law, at least in the Mexican case—which is of our interest—is not only directed to members of organized crime groups, but also to public servants who, during their term in office in the Public Administration and after leaving office, are connected with criminal organizations to perpetuate crimes that severely harm our society. Such assertions will be later demonstrated in detail in the following sections of this article. Finally, it is important to highlight that this article was drafted within the framework of a Doctorate in Organizations Intervention at Universidad Autónoma Metropolitana (UAM), Azcapotzalco Unit, Mexico City, Mexico.El presente artículo tiene por objetivo demostrar la existencia del derecho penal del enemigo del profesor doctor Günther Jakobs en las estructuras normativas mexicanas y en los tratados internacionales de los que el Estado mexicano forma parte, a efectos de combatir a los sujetos potencialmente peligrosos —enemigos— que ponen en riesgo, con su actuar, el equilibrio del sistema social. Sin embargo, la aplicabilidad de este derecho, por lo menos en el caso mexicano que es el de nuestro interés, no solo está direccionado a los miembros de la delincuencia organizada, sino también a las servidoras y los servidores públicos que, en el ejercicio de sus funciones en la Administración pública, y posterior a ellas, tengan nexos con las organizaciones criminales para perpetuar delitos que laceran severamente a la sociedad. Tales aseveraciones serán demostradas puntualmente en las líneas posteriores de cada uno de los siguientes epígrafes que integran este escrito.
