For this reason, the paper proposes the implementation of implicit res judicata, based on comparative experiences in Spanish and Anglo-Saxon law, where the scope of res judicata is extended to issues that were not debated but could have been raised in the initial proceedings. This approach allows for a much more efficient judicial system by reducing the number of cases concerning similar matters.El artículo desarrolla la institución de la cosa juzgada en el derecho procesal peruano, enfatizando su rol en la estabilidad y la seguridad jurídica. Estudia cómo en el derecho peruano se encuentra vigente la teoría de la «triple identidad» (partes, objeto y causa) para determinar la cosa juzgada, ello aunado a las limitaciones que genera dicha concepción en cuanto a la resolución de conflictos. Por este motivo se propone la implementación de la cosa juzgada implícita, basada en la experiencia en el derecho comparado español y anglosajón, donde se amplía la cobertura de la cosa juzgada a cuestionamientos no debatidos, pero que pudieron haberse planteado en el proceso inicial. De ese modo se permite una conformación de un sistema judicial mucho más eficiente, producto de la reducción de procesos sobre asuntos similares.O artigo desenvolve a instituição da coisa julgada no direito processual peruano, enfatizando seu papel na estabilidade e na segurança jurídica. Examina como, no direito peruano, vigora a teoria da “tríplice identidade” (partes, objeto e causa) para determinar a coisa julgada, juntamente com as limitações que essa concepção gera na resolução de conflitos. Por esse motivo, propõe-se a implementação da coisa julgada implícita, baseada na experiência do direito comparado espanhol e anglo-saxão, onde se amplia o alcance da coisa julgada a questões não debatidas, mas que poderiam ter sido suscitadas no processo inicial.
