description La crisis migratoria venezolana originada por la violación masiva de derechos humanos y la alteración del orden público, reconocida por la Comisión Interamericana de Derechos Humanos y el ACNUR, ha puesto a prueba la Declaración de Cartagena de 1984, que establece una concepción amplia de refugiado, la misma que es reconocida parte del corpus iuris del Sistema Interamericano de Derechos Humanos. En ese sentido, se sustenta jurídica y jurisprudencialmente su aplicación por parte de los principales Estados receptores de migrantes como son Colombia, Ecuador, Perú y Chile, quienes han adoptado medidas de protección subsidiaria en lugar de garantizar y promover el derecho al asilo con base a la Declaración e incluso han promovido expulsiones masivas de migrantes. Asimismo, las Cortes y Tribunales Constitucionales los han considerado como migrante económicos y no como refugiados. Esta situación refleja la falta de aplicación del principio pro homine y la garantía del pleno ejercicio de los derechos y libertades fundamentales.
