La normativa peruana de hostigamiento sexual establece que el mismo se configura frente a una conducta de naturaleza sexual o sexista que no es deseada por la persona contra la que se dirige. Sin embargo, la legislación no precisa cuáles son los alcances del deseo (o consentimiento) que evita la configuración de casos de hostigamiento sexual. En ese sentido, el autor analiza, desde un enfoque de género, la regulación del hostigamiento sexual laboral y el estándar interpretativo que debe darse al elemento del consentimiento. En dicho análisis se incluye la comparación con el estándar que se maneja del mismo concepto en el derecho penal para el delito de acoso sexual. La propuesta del autor es que el consentimiento que exige la normativa peruana, bajo una interpretación sistemática, es la tesis del consentimiento afirmativo que exige que el consentimiento sea informado, específico, libre, entusiasta y que pueda ser revertido en cualquier momento. |

However, the legislation doesn't specify the standar of consent that prevents the configuration of sexual harassment. In this article, the author analyzes, from a gender perspective, the regulation of workplace sexual harassment and the interpretative standard that must be given to the element of consent. This analysis includes the approach to criminal law for the crime of sexual harassment. The author's proposal is that Peruvian regulation, under a systematic interpretation, requires an affirmative consent.
