Para esto, en primer lugar, se analizará Sentencia de Casación N°9706-2017-Lima-Sur, en dónde la Corte Suprema se analizó un caso de duplicidad de partidas, en el que ambas partes afirmaban tener la titularidad de la propiedad del inmueble y era necesario determinar cuál de los dos títulos se debía preferir sobre el otro. De esta manera, para realizar dicho análisis, primero se revisará los antecedentes del caso, así como el análisis que realizó originalmente la Corte Suprema. A partir de dicha revisión, se procederá a analizar la duplicidad de partidas, el por qué se considera una patología del registro, y por qué no son aplicables los derechos registrales en estos casos. Por último, se analizará el mejor derecho de propiedad y el criterio que se debe emplear ante los casos en que se haya generado un conflicto de derechos debido a la existencia de la duplicidad de partidas.

For this, in the first place, the judgment of Cassation N ° 9706-2017-Lima-Sur will be analyzed, where the Supreme Court analyzed a case of duplication of items, in which both parties claimed to have ownership of the property of the property and it was necessary to determine which of the two titles should be preferred over the other.
