Esta Resolución abarca un procedimiento administrativo sancionador en materia de Discriminación en el Consumo y Deber de idoneidad, iniciado por la consumidora Cielo Macarena García de Lama contra Iberia Líneas Aéreas de España Sociedad Anonima Operadora. La relación de consumo en el caso es por la compra de un boleto aéreo con ruta Lima – Madrid, pero dicho contrato de consumo no se ejecutó a causa de comentarios discriminatorios que el personal de la proveedora emitió contra la señora Cielo García. Asimismo, se evaluará la falta de deber de idoneidad, el derecho de información y el derecho a la entrega del libro de reclamaciones. Luego de haber realizado la descripción de los hechos y el juicio de valoración correspondiente a los medios probatorios presentado por la denunciante se argumentó que esta conducta que originó la proveedora es un acto de discriminación, por posicionar la carrera artística del maquillaje como inferior, en contraste a una profesión o carrera realizada en una universidad. Específicamente, en un análisis en conjunto, se concluye que sí hubo vulneración del Artículo 1°, 2°, 18°,19°, 38°, 152° del Código de Protección y Defensa del Consumidor Peruano.

This Resolution covers an administrative sanctioning procedure in matters of Discrimination in Consumption and Duty of Suitability, initiated by the consumer Cielo Macarena García de Lama against Iberia Líneas Aéreas de España Sociedad Anónima Operadora. The consumer relationship in the case concerns the purchase of an airline ticket for the Lima – Madrid route, but this consumer contract was not executed due to discriminatory comments made by the provider's staff against Mrs. Cielo García. Likewise, the lack of duty of suitability, the right to information, and the right to the delivery of the complaints book will be evaluated. After describing the facts and the corresponding assessment of the evidence presented by the complainant, it was argued that the provider's conduct constituted an act of discrimination by positioning the artistic career of makeup as inferior in contrast to a profession or career pursued at a university.
