description El presente informe tiene como finalidad desarrollar y analizar los hechos, los puntos controversiales y los argumentos resolutivos del Expediente N°2573-2012/CPC, el cual trata sobre la denuncia interpuesta por el señor Luis Alberto López de Castilla Bado, quién aduce que existe una falta al deber de idoneidad por la afectación a su expectativa de recibir el departamento N°701 del proyecto de edificación de la Residencial “San Antonio”, cuyo metraje sufrió una presunta reducción de forma unilateral y sin su consentimiento; asimismo, esta afectación se encuentra relacionada a su expectativa de recibir el bien inmueble en la fecha pactada en el “Contrato de Compraventa de bien futuro” suscrito entre las partes el 29 de abril de 2010. Bajo estos argumentos, el denunciante considera que siempre que existe un incumplimiento de todas o algunas de las obligaciones contractuales, se debe sancionar al proveer por la transgresión, vulneración e infracción al deber de idoneidad de los productos y servicio inmobiliario, estipulado en los artículos 18° y 19° en la Ley N°29751, Código de Protección y Defensa del Consumidor.
