description El presente trabajo es una continuación del trabajo académico anterior de la autora llamado “Análisis de la Resolución N° 200-2020-SUNARP-TR-T”, Pleno Registral CCXLIII en abril del 2021, en donde el Tribunal Registral determina que es procedente la independización de aires sobre aires siempre que se haya cumplido con asignar porcentajes de participación para las secciones exclusivas futuras, así como que se presente un plano de las áreas resultantes especificando su altura. En ese sentido, se inicia analizando si es que el Tribunal Registral cuenta con las competencias necesarias para poder crear una nueva institución jurídica, para posteriormente realizar un análisis respecto a la naturaleza de esta nueva institución jurídica de aires sobre aires y así poder determinar finalmente si nuestro sistema jurídico se encuentra preparado para introducir la referida figura jurídica teniendo en cuenta que su sola creación no solo implica la vulneración a normas que se encuentran vigentes en la actualidad en el ámbito urbanístico sino que también involucra una vulneración a principios registrales teniendo como consecuencia generar un debilitamiento en el sistema registral peruano que ha venido avanzando con los años.
