Nuestro método de investigación parte por un análisis de la normatividad peruana del fuero sindical y su interpretación por parte de la doctrina y la Corte Suprema, además de las recomendaciones del Comité de Libertad Sindical, para luego analizar las razones jurídicas que justificarían la regulación del despido propuesta. Finalmente, realizaremos una comparación de la normatividad nacional con el resto de Latinoamérica y formularemos una propuesta legislativa para regular el despido propuesta en Perú. Concluimos que la regulación del despido propuesta se justifica en la necesidad de garantizar un debido procedimiento, que incluya el deber de imparcialidad, y otorgar una tutela más elevada de la libertad sindical. Por otra parte, entre los países de Latinoamérica que adoptan el modelo de pluralismo sindical en sus relaciones colectivas, Perú es el único país de la región que no ha regulado el despido propuesta ni otros mecanismos compensatorios -como permitir que los dirigentes despedidos puedan participar en la comisión negociadora- para fortalecer el fuero sindical, lo cual es un hecho que debería llamar la atención para enmendar esta situación.

Our research method starts with an analysis of the Peruvian rules and regulations of the trade union rights and their interpretation by the academic legal opinion and the Supreme Court, in addition to the recommendations of the Freedom of Association Committee. Then, it analyzes the legal reasons for the proposed regulation of dismissal. Finally, a comparison of national rules and regulations with those of the rest of Latin America is made, and a draft legislation on the proposed dismissal in Peru is developed. Our conclusion is that the regulation on the proposed dismissal is grounded in the need to guarantee due process, including the duty of impartiality, and to provide greater protection of freedom of association. On the other hand, among the Latin American countries that adopt the model of trade union pluralism in their collective relations, Peru is the only country in the region that has not regulated the proposed dismissal or other compensatory mechanisms -such as allowing dismissed leaders of trade unions bargain collectively- to strengthen the trade union rights.
