Es precisamente esa ausencia de sistematicidad de la parte general del procedimiento administrativo sancionador laboral, la que ocasiona que muchas veces la Autoridad Administrativa de Trabajo tenga que “hacer camino al andar” al momento de resolver los expedientes inspectivos. Ello se traduce en una cierta tendencia a someter los aspectos sustantivos y procesales de la inspección a los vaivenes de las políticas laborales o incluso de las ideologías pro-trabajador o pro-empleador imperantes en determinadas coyunturas (tal como se puede deducir de algunas directivas que han sido emitidas a lo largo de la existencia de la Dirección General de Inspección de Trabajo). |
