A propósito de la normativa (Ley N° 29151) pues dicha norma nos deja claro los procedimientos a seguir para lograr sanear físico y legalmente los predios del Estado inscritos o no a nombre de este, es decir el saneamiento físico legal de propiedad del Estado, sin embargo para sanear físico y legalmente los predios en posesión del Estado inscritos a nombre de particulares nos remite a las normas de derecho común, frente a ello el presente trabajo estará enfocado en determinar si es viable el saneamiento del predio en posesión del Estado a favor de este por la causal de abandono por el titular registral, determinar si es viable el saneamiento físico legal del predio en posesión del Estado a favor de este mediante prescripción adquisitiva notarial y determinar si es viable el saneamiento físico legal del predio en posesión del Estado a favor de este mediante permuta. Asimismo, se analiza la importancia de contar con predios en el Estado debidamente saneados física y legalmente. Finalmente desarrollo los mecanismos que resultan aplicables frente a diversas situaciones que pueden surgir o viene presentando el Estado.
