description La subsanación voluntaria de forma previa al inicio del procedimiento administrativo sancionador constituye un eximente de responsabilidad administrativa conforme a lo dispuesto en el Decreto Legislativo 1272, el cual trajo esta modificación a la Ley 27444 – Ley del Procedimiento Administrativo General. Asimismo, a través del mencionado Decreto Legislativo, se dispone que la Ley del Procedimiento Administrativo General pasa a tener la condición de Ley común, estableciendo para tal efecto la pauta normativa que debe regir toda actuación administrativa. Sin embargo, como se puede apreciar en el presente trabajo, organismos reguladores como el OSINERGMIN han señalado a través de Resoluciones de Consejo Directivo, Reglamentos; entre otros, disposiciones que proponen un régimen diferente y menos beneficioso para el administrado, adaptando la institución de la subsanación voluntaria de una forma que vulneraría lo establecido en la Ley del Procedimiento Administrativo General, afectado de esta forma su carácter de Ley común, bajo un supuesto precepto de especialidad. Sobre el particular, se propone que tanto los organismos reguladores como las demás instituciones y entidades de carácter administrativo establezcan una regla de carácter común respecto a la figura de la subsanación voluntaria, ello con el objetivo de buscar la uniformidad e integración del sistema jurídico, sin que ello vulnere las pautas básicas dispuestas por Ley.

Likewise, through said Legislative Decree, it is provided that the General Administrative Procedure Law becomes a common Law, establishing for such purpose the normative guideline that must govern all administrative actions. However, as can be seen in this work, regulatory agencies such as OSINERGMIN have indicated, through Resolutions of the Board of Directors, Regulations, among others, provisions that propose a different and less beneficial regime for the administered party, adapting the institution of voluntary rectification in a way that would violate the provisions of the General Administrative Procedure Law, thus affecting its status as a common Law, under an alleged precept of specialty.
