The analysis of this case focuses on verifying whether the technological and structural reasons that were invoked as an objective cause are indeed present. Likewise, part of the analysis includes the justification offered by the General Directorate of Labor (DGT) regarding the positive administrative silence that in the first instance was not applied in favour of the company as an administered subject.
