El objetivo es demostrar cómo la figura actual de apoyos y salvaguardias, incluso cuando quien es designado como apoyo a nivel judicial pueda contar con facultades de representación, es insuficiente para proteger ciertos derechos de este grupo de personas, como lo son estos derechos patrimoniales, y por ello surge la necesidad urgente de poder otorgar representación legal a los apoyos y de establecer facilidades procesales que permitan que una persona con discapacidad neurológica severa diagnosticada al nacer cuente con la posibilidad y asistencia necesaria para disponer y/o afectar sus bienes con el fin de salvaguardar su bienestar y necesidades específicas. Finalmente, también se evaluará la razón de ser de la modificación antes mencionada, que deriva del modelo social de discapacidad, apoyándose de la doctrina nacional e internacional que resulte pertinente para luego establecer las formalidades para disponer y afectar bienes en el Perú y las consecuencias y dificultades para este grupo de personas y su entorno al momento de salvaguardar sus derechos y su bienestar integral

The objective is to demonstrate how the current figure of supports and safeguards, even when whoever is designated as support from a judge may have powers of representation, is insufficient to protect certain rights of this group of people, such as these patrimonial rights. For this reason, there is an urgent need to grant legal representation to the supports and to establish procedural facilities that allow a person with a severe neurological disability diagnosed at birth to have the possibility and necessary assistance to dispose of and/or affect their assets in order to safeguard their well-being and specific needs.
