Thus, through this exercise, the definition of “environment” is expanded as the set of both external and internal conditions that influence the consent of the passive subject, highlighting the internal conditions as those produced within the human mind through the formation of an idea or scenarios in the victim with the purpose of consenting to the sexual act. With this new concept, the crime of rape by deception is included within the base crime of rape. This will make it possible to make visible and criminalize unfortunately normalized behaviors such as stealthing, using the deductive research method for this work.El delito de violación sexual mediante engaño tipificado en el artículo 175 del Código Penal Peruano presenta una incorrecta ubicación legislativa, por lo que el objetivo de esta investigación es postular una reubicación de este delito hacia el tipo penal base de violación sexual en el artículo 170 del Código Penal Peruano, utilizando como medio para lograrlo el análisis del concepto de “entorno” en el que la víctima no puede dar su libre consentimiento. Es así que, mediante este ejercicio, la definición de “entorno” se amplía como el conjunto de condiciones tanto externas como internas que influyen en el consentimiento del sujeto pasivo, resaltando las condiciones internas como aquellas producidas dentro de la mente humana mediante la formación de una idea o escenarios en la víctima con la finalidad de consentir el acto sexual. Con este nuevo concepto, se incluye el delito de violación sexual mediante engaño dentro del delito base de violación sexual. Esto permitirá visibilizar y criminalizar conductas lamentablemente normalizadas como el stealthing, utilizando para esta labor el método de investigación deductivo.
