The aim is to question the legitimacy of this practice and analyze possible solutions, assessing their compatibility with the constitutional rights of the accused, especially their right to defense. An exhaustive analysis of procedural criminal regulation, case law, and related doctrine concerning this practice is conducted. It is concluded that the "shadow accused" is not a legitimate investigative strategy but rather a practice that violates the rights of the accused, emphasizing the importance of rights protection as a means to halt this violation and ensure greater protection of the accused's rights in the criminal process.Este artículo examina la práctica del Ministerio Público por la cual una persona contra la que se dirige una imputación material, de manera injustificada, no es comprendida formalmente en la investigación en la creencia de evitar que pudiera obstruir los fines de la misma; mientras se llevan a cabo diligencias encaminadas a recabar elementos de convicción que buscarían determinar su responsabilidad. El objetivo es cuestionar la legitimidad de esta práctica y analizar posibles soluciones, evaluando su compatibilidad con los derechos constitucionales del imputado, especialmente su derecho a la defensa. Se realiza un análisis exhaustivo de la regulación procesal penal, la jurisprudencia y la doctrina relacionada con esta práctica.
