Sumario:The research analyzes the effects of the reform introduced by Article 6 of the New Constitutional Procedural Code, which prohibits the summary dismissal of claims in constitutional proceedings such as amparo, compliance, habeas data, and habeas corpus. The main purpose is to assess whether this prohibition is consistent with the principles of effective judicial protection, procedural economy, and speed, as well as with the judicial autonomy recognized in the Constitution. A descriptive-explanatory design was applied, using documentary analysis of regulations, Constitutional Court jurisprudence, and specialized doctrine. The results show that, although the reform seeks to guarantee access to justice, it also generates procedural overload and delays proceedings by forcing the processing of manifestly inadmissible claims. It is found that an equally satisfactory remedy in the ordinary sphere is an essential criterion for declaring preliminary inadmissibility, in accordance with the Elgo Ríos precedent, allowing for the optimization of constitutional justice. It is concluded that a rigid application of Article 6 may affect the efficiency of the system and real access to justice, and therefore a corrective interpretation is proposed to restore preliminary rejection.
