The article seeks to examine the interpretative scope of the unlawfulness as a sine qua non for the proceeding of the forfeiture of ownership in Peru, based on the current regulation and application that has been taking place in this matter. The unlawfulness is not limited to a criminal unlawfulness, but to any type of unlawfulness: criminal, civil, administrative, tax, etc., which entails an extremely broad unlawfulness. The objective is to determine the viability of this practice and to propose some solutions, considering the constitutional framework and the unrestricted respect for fundamental rights, particularly in the interpretation of the norm for the restriction of rights. A study is carried out focused on the procedural regulation of the extinguishment of ownership and doctrine related to unlawfulness. It is established that the interpretative scope given to unlawfulness is broad, not taking into consideration the restrictive interpretation of fundamental rights, but deliberately broadening it to extinguish the domain of those required, highlighting the constitutional interpretation as a control mechanism against the violation of rights and guaranteeing an adequate application of the norm in the process.
