Other studies carried out from comparative law are taken into account. The advantages and disadvantages of this regulation in the development of the minor are analyzed, considering the changes introduced by the new legislation. The comparative legal method is used based on a review of the bibliography from a documentary analysis in which judicial files related to shared ownership in Peru are reviewed. The influence of regulatory changes in guaranteeing the best interests of the minor is assessed. Criteria that determine the effectiveness and possible impacts of shared ownership on the families that adopt it are evaluated.El artículo examina la reciente regulación de la tenencia compartida en Perú y su impacto en el Principio del Interés Superior del Niño y Adolescente. Se tienen en cuenta otros estudios realizados desde el derecho comparado. Se analizan las ventajas y desventajas de esta regulación en el desarrollo del menor, considerando los cambios introducidos por la nueva legislación. Se utiliza el método jurídico comparado basado en una revisión de la bibliografía desde un análisis documental en el que se revisan expedientes judiciales relacionados con la tenencia compartida en Perú. Se valora la influencia de los cambios normativos en la garantía del interés superior del menor.
