This work, through deductive reasoning, explores the relevance of the constitutional apprehension of political asylum as a mechanism for protecting human rights, examining international jurisprudential and casuistic interactions in conflicts between states related to political asylum, such as the cases of Haya de la Torre, Alan García, the Colombian embassy, and the incident involving Evo Morales. Furthermore, it seeks to clarify the criteria for the use of international mechanisms according to constitutional doctrine, the regulation of political asylum, and the internal factors that influence this issue, generating a reconsideration of prevailing ideas in contemporary doctrine due to divergent opinions in academia and the persistent subjectivity in the definition of political persecution.
