This regulation is problematic in terms of compatibility with the principle of minimal intervention of Criminal Law. In this context, the need to modify the mentioned article is raised, in order to encompass within its notion of non-punishable possession the possession of drugs intended for one's own immediate consumption, regardless of whether it involves one or several types of substances, as long as the stipulated minimum quantities are respected. It is important to emphasize that this modification would not apply in cases where possession serves purposes other than personal consumption. Consequently, this proposal seeks to offer a more coherent and in line with the principle of minimal intervention, while addressing a relevant issue in the penal domain.Este artículo aborda una cuestión de gran relevancia en relación con la regulación contenida en el segundo párrafo del artículo 299 del Código Penal. Esta disposición legal suscita preocupación debido a su exclusión de la exención de responsabilidad penal en situaciones donde la posesión involucra dos o más tipos de drogas. Esta normativa resulta problemática en términos de compatibilidad con el principio de mínima intervención del Derecho Penal. En este contexto, se plantea la necesidad de modificar el artículo mencionado, con el propósito de que abarque en su noción de posesión no punible la tenencia de droga destinada al propio e inmediato consumo, independientemente de si se trata de uno o varios tipos de sustancias, siempre y cuando se respeten las cantidades mínimas estipuladas. Es importante subrayar que esta modificación no sería aplicable en casos donde la posesión tenga propósitos diferentes al consumo personal.
