With this, it is intended to support that, given the impossibility of using punitive damages as they have not been introduced in our system by a law, the quantification of moral damages can be used to award punitive damages as a means to reinforce the protection of the fundamental rights of the victim. In order to carry out the above, a socio-legal research method (aimed at analyzing real cases such as sentences) and a dogmatic-legal method (aimed at analyzing the legal foundations of punitive damages and moral damages) have been used in order to fulfill the proposed objective. Finally, some approximations are presented as a conclusion.El objetivo principal fue determinar los fundamentos para aplicar el criterio punitivo en la cuantificación del daño moral como un medio para reforzar la tutela de los derechos fundamentales de la víctima en el Perú. Con ello, se pretende sustentar que, ante la imposibilidad de utilizar los daños punitivos al no haber sido introducidos en nuestro sistema por una ley, se puede utilizar la cuantificación del daño moral para otorgar un resarcimiento sancionador como un medio para reforzar la tutela de los derechos fundamentales de la víctima. Para llevar a cabo lo anterior se ha utilizado un método de investigación socio-jurídico (destinado analizar casos reales como son las sentencias) y dogmático-jurídico (destinado a analizar los fundamentos jurídicos del daño punitivo y el daño moral), a fin de cumplir con el objetivo propuesto.
