The sample consisted of 275 files, all of which were processed for omission of family assistance under the criminal type of non-compliance with child support obligations, typified in article 149 of the Penal Code. In order to collect the research data, the documentary analysis technique was used and the instrument used was a data collection form. It was found that 49.09% of the files showed debts of between 16 and 20 months of unpaid alimony, 29.09% of the accused had a debt of between S/2,001 Soles and S/4,000 Soles; and in 75.27% the full payment was not made within a reasonable period, considering the needs of the alimony payers. Finally, it was established that in 82% of the processes analyzed, the child's right to an adequate standard of living was violated, preventing him/her from achieving his/her full development. The investigation concluded that the failure to comply with the child support obligation due to the application of the principle of opportunity violates the right of the child support provider (p: 0.000).La investigación buscó establecer si el incumplimiento de obligación alimentaria por la aplicación del principio de oportunidad vulnera el derecho del niño alimentista a tener un nivel de vida adecuado para su pleno desarrollo en una Provincia del Perú. Para ello se desarrolló una investigación no experimental de diseño transversal, de nivel relacional. La muestra estuvo constituida por 275 expedientes la totalidad de proceso por omisión de asistencia familiar bajo el tipo penal de incumplimiento de obligación alimentaria, tipificado en el artículo 149 del Código Penal. Para poder recopilar los datos de la investigación se utilizó la técnica de análisis documental y el instrumento utilizado fue una ficha de recojo de datos. Se halló que el 49.09% de las carpetas mostraban deudas de entre 16 y 20 meses de pensión alimenticia impaga, el 29.09% de imputados tenían una deuda de entre S/2,001 Soles y S/4,000 Soles, y en el 75.27% el pago íntegro no se realizó en un plazo razonable considerando las necesidades de los alimentistas. Finalmente, se pudo establecer que en el 82% de los procesos analizados, sí se vulneró el derecho del niño a tener un nivel de vida adecuado que le impide lograr su pleno desarrollo.
