The purpose of this article is to contribute to clarify a discussion on the development scenario of the stakeholders in which the dialogue between companies and local groups could be guaranteed. The frame of reference that the author takes is the foundation of Habermas's discourse ethics. As an essay, the author starts from practical ethics and legal theory, presents the most important premises about what corporate social responsibility is from the interest group theory approach; with an emphasis on local communities; In addition, he tries to explain the reasons that justify why companies —especially extractive ones— have social responsibilities, exposing the most outstanding criticisms against the CSR approach and how such arguments suffer from drawbacks in their foundation. El autor a  manera de  ensayo parte de la ética práctica y la teoría del Derecho, presenta las premisas más importantes acerca de lo que es la RSE a partir del enfoque de la teoría de los grupos de interés; con interés en las comunidades locales; además, trata de explicar  las razones que justifican por qué las empresas—en especial las extractivas— poseen responsabilidades sociales, exponiendo las críticas más resaltantes contra el enfoque de la RSE y cómo tales argumentaciones adolecen de inconvenientes en su fundamentación Propone comprender la RSE a partir de la importancia del diálogo entendido desde la teoría de la ética discursiva de Jürgen Habermas, plantea la propuesta que tratará de demostrar que  el enfoque habermasiano de diálogo en la RSE consolida el debido ejercicio.

El Perú cuenta con una vasta pluralidad  cultural, la cual se ve reflejada en los distintos pueblos oriundos de la sierra y la selva. Es por ello que el Estado reconoce a estas comunidades y las busca proteger. Sin embargo, en este mismo contexto surgen conflictos a raíz de que se excluyen a estas comunidades de la toma de decisiones sobre el aprovechamiento de recursos naturales que se encuentran en las zonas donde residen. La anterior contradicción la aborda el autor a partir del tema de la participación  ciudadana, no limitándose solo a un análisis jurídico sino también abarcando un plano social. Este es sin duda un artículo que nos invita a la reflexión.
