La definición de operación de concentración en el sistema peruano de control de concentraciones puede abarcar un número considerable de transacciones. Si bien esta característica permite que el sistema capture transacciones que podrían ser riesgosas para la competencia, también ocasiona falta de certeza sobre si determinadas transacciones configuran una operación de concentración. En la presente tesis se propone la adopción de tres criterios de interpretación al momento de analizar si una transacción se encuentra dentro de la definición de operación de concentración: la vocación de permanencia, el concepto estricto de activos productivos y la valoración integral de los derechos a ser adquiridos.
