El Decreto Legislativo 1568, del Régimen de la Propiedad Horizontal, ha reconocido lo que en doctrina y jurisprudencia ya se venía desarrollando con meridiano consenso, a saber, que la Junta de Propietarios ostenta subjetividad relativa, es decir, que tiene la categoría de sujeto de derecho con plena capacidad de ejercicio, aunque sin contar con personería jurídica. Para el autor este reconocimiento es un paso más en la evolución dogmático jurídica de este ente no personificado, que el Poder Ejecutivo ha tenido a bien disponer a causa de los requerimientos prácticos de las comunidades de propietarios sometidos a este régimen especial de la propiedad predial. Así, con la finalidad de que la Junta de Propietarios concretice su subjetividad relativa, el autor presenta algunas fórmulas normativas que viene proponiendo en el proceso de reglamentación.

 The patrimonial responsibility of the State is an issue belonging to the general part of administrative law. In Peruvian law, this institution does not have a clear and deep theoretical development as the civil liability system applied in private law does. Through this paper, the author outlines some generic considerations on the foundations of the duty to compensate by the Public Administration, generated when, in the exercise of its legally attributed powers, it causes injuries to the legally protected interests of the administered. Thus, the purpose of this work is to establish an approximation at the national headquarters on the theory of the patrimonial responsibility of the State, without prejudice to recognizing the influence of some institutions of private law.

During the provisional government of marshal Ramón Castilla (1855-1858), the National Convention installed in 1855, promulgated the Transitory Law of Municipalities on January 2, 1857. This law provided for the creation of municipalities in 691 districts included in the then existing provinces and departments, among which the district of Iquicha, located in the province of Huanta, region of Ayacucho, is mentioned. However, due to socio-political events and conflicts that affected the cohesion, life and development of this community, the demarcation action was not carried out. Already in 2022, the author of this work was contacted with some representatives of the Iquichana community –resettled in a perfectly determinable high Andean area as they were told– to take some legal action aimed at demanding the Peruv...

The disorderly and spontaneous grow of cities and population centers is a characteristic of the Peruvian urbanism that is impossible to deny. In this regard, the housing deficit and the informal occupation of land, the impairment of the environment, and the deterioration of the cultural heritage of the nation are problematics that require priority attention.  In this article, the author aims to expose the inefficient planning of the Peruvian State in urban development based on the three problematic axes mentioned above. Along the same lines he argues that a key factor in these problems has been regulatory inconsistency; therefore, it develops the main historical antecedents of Peruvian urban planning legislation, in order to demonstrate that state disarticulation in the management of land use is a characteristic of national urbanism. In this paper, the author develops some elementary topics on the administrative lapse of the sanctioning procedure, such as the notion of sanctioning power, its constitutional basis, and its purpose and functioning, based on the regulation contained in the General Administrative Procedure Act. Finally, in order to illustrate the functioning of this institution, it presents a case decided by the Tribunal de Fiscalización Ambiental del Organismo de Evaluación y Fiscalización Ambiental, in which it declared null and void a decision of the investigating body ordering the extension of the limitation period without adequate justification.

Este trabajo tiene como objetivo analizar desde un enfoque constitucional la tan problemática figura del tercero de buena fe registral, no sin observar algunos criterios que el derecho civil ha desarrollado sobre este asunto en razón a su especialidad. Así pues, nos encargaremos de disgregar la ratio decidendi que conllevó a los magistrados –en voto mayoritario– a resolver que el supuesto de hecho descrito y regulado en el artículo 2014 del C.C., no mereció ser expulsado del ordenamiento jurídico, siendo esto sumamente paradójico considerando que una de las garantías del Sistema Nacional de los Registros Públicos (Sinarp) es la seguridad jurídica que la publicidad registral debería extender a los actos y derechos inscritos.
