The aim of this article is to introduce the specific regulation on the special protection that International Humanitarian Law provides to medical personnel and medical units in the context of armed conflicts. What is more, it seeks to present the current panorama in relation to compliance with this special protection in different conflict zones such as Syria and Afghanistan, as well as the case law development in the International Tribunal for the Former Yugoslavia and the International Criminal Court. Finally, the article presents a brief analysis of the situation in the Gaza Strip, especially in relation to the attack on Al Shifa Hospital.

El presente trabajo de investigación tiene como objetivo central demostrar que la obligación de reparar subsiste en el contexto de una sucesión de Estados, especialmente en aquellos casos en donde el Estado predecesor deja de existir. A raíz de la evolución de la práctica estatal y jurisprudencia de tribunales internos e internacionales, se podrá advertir un cambio de paradigma dentro de la doctrina, pasando por teorías que afirman y niegan una posible sucesión automática en la responsabilidad internacional, a un enfoque contemporáneo que, apuesta por una sucesión de la obligación, más importante pero no la única, que nace de la responsabilidad internacional: la obligación de reparar. Como parte de los resultados de este análisis, se podrá verificar que no existe una norma consuetudinaria que avale la sucesión automática de la obligación de reparar; sin embargo, ello...

The constant politicization of the succession of States has been a problem when regulating how to regulate its effects. In the first codifying attempts, international responsibility was not ddressed as part of the study on the effects of this phenomenon. However, thanks to the wide acceptance of the work of the International Law Commission of the United Nations in its work on the international responsibility of the State, it is no longer possible to invoke the succession of States to undermine the enforceability of the obligation to repair that has arising out of the commission of an internationally wrongful act. This dogmatic change will provide more light for an eventual regulation of the subject under analysis, but it could also be useful for the constant claims of States that, in their past life, were colonies where atrocities were perpetuated.
