En el presente informe jurídico se analizará la sentencia del Tribunal Constitucional del EXP N.° 01587-2018-PHC/TC, la cual versa sobre el interés superior del niño en el marco de una investigación penal. En tal sentencia, el Tribunal Constitucional declara fundada en parte la demanda. El problema jurídico principal se centra en determinar si se debe declarar fundada o no la demanda interpuesta ante el Tribunal Constitucional a favor de las hijas de Ollanta Humala y Nadine Heredia en contra del fiscal Germán Juárez Atoche, quien ordenó, por medio de la providencia 204-2017, que fiscales adjuntos provinciales se apersonaran al colegio de las niñas. The Peruvian legal framework on gambling includes among its purposes the prevention of compulsive gambling in minors by restricting their access to gambling halls. However, there is a legal vacuum regarding virtual games of chance that can be found included in videogames, which are freely available to children and adolescents, representing a risk for this vulnerable sector that must be addressed. In this regard, the main objective of this research work is to present a proposal for the regulation of games of chance included in video games. For this, in the first chapter, the concept of video game, its market and its risks will be developed in detail.
